Please read these terms carefully before using SoftCanada Auctions. By registering an account, placing a bid, or using this platform, you agree to be bound by everything on this page. If you don't agree, please don't use the platform.

What we are

About SoftCanada Auctions

SoftCanada Auctions is an online timed auction platform incorporated in Ontario, Canada. We sell general merchandise, primarily retailer returns, overstock, and cleared inventory purchased from wholesale liquidators, directly to the public. We are the sole seller on this platform. There are no third-party sellers.

Our warehouse in Hamilton, Ontario is for order pickup only. It is not open to the public for browsing or walk-in purchases. You can only collect items you have already purchased through the platform during the designated pickup window.

This platform is intended for use by individuals and businesses located in Canada.

Accounts

Registration and eligibility

You must create a free registered account to place bids. By registering, you confirm that:

You are at least 18 years old

You have the legal capacity to enter into a binding agreement

If registering on behalf of a business, you have authority to do so

All information you provide is accurate and current

Payment method required

A valid credit card or approved payment method is required to register. By registering, you authorize SoftCanada Auctions to automatically charge your payment method for any item you win — without requiring further confirmation at the time of charge. No bids can be placed without a valid payment method on file.

Account security

You are responsible for keeping your login credentials confidential and for all activity under your account. If you suspect unauthorized access, contact us immediately.

Consumer vs. business status

During registration you will be asked whether you are purchasing for personal/household use or for business purposes. Your selection affects the legal rights and obligations that apply to your purchases. Please select accurately.

Auction and Bidding

How auctions work

New auction listings are posted on or about Friday each week and remain open for approximately five days, closing on or about the following Tuesday (or as specified for each item). All items open at a starting bid of $1.00 unless otherwise stated. There is no reserve price unless expressly noted in the listing.

Bids are binding

Every bid is a legally binding offer to purchase
By placing a bid, you are making an irrevocable offer to buy that item at that price if your bid wins. Bids cannot be retracted once submitted. Only bid what you are prepared and financially able to pay.

Winning and closing

The highest bid at the auction closing date and time wins. The winning bidder receives an order confirmation by email with the purchase price and pickup window. Lots close in rolling groups — not all at once. Each lot has its own countdown timer.

Our right to cancel or modify

We reserve the right to cancel, extend, or modify any auction before it closes — for example, due to a listing error or a question about the item's condition. If an auction is cancelled after you have been charged, you will receive a full refund.

No shill bidding

We do not engage in shill bidding. All bids are placed by genuine, independent registered users. Any attempt to artificially inflate bids through bots, scripts, or coordinated arrangements is strictly prohibited and may result in account suspension and legal action.

Payment

Automatic charge

When an auction closes, the winning bidder's payment method is automatically charged the purchase price. Payments are processed through Stripe. All prices are exclusive of applicable taxes. Harmonized Sales Tax (HST) will be added where required by law and shown on your order confirmation.

All sales are final

Subject to the cancellation and return rights described below, all sales are final. We do not accept returns or exchanges except as required by applicable law.

Failed payment

If your payment fails, we reserve the right to cancel the sale, re-list the item, and suspend or terminate your account.

Chargebacks

By bidding, you acknowledge that the sale is binding and that you will not initiate a chargeback with your card issuer except in cases of genuine fraud by a third party. Chargebacks based on change of mind, dissatisfaction with a disclosed condition, or false claims of unauthorized purchase are a breach of this agreement. We reserve the right to pursue legal action, report the matter to credit agencies, and permanently ban your account in such cases.

Pickup and delivery

Pickup

All items must be collected from our warehouse in Hamilton, Ontario during the pickup window specified in your order confirmation. Bring valid government-issued photo ID and your order confirmation. If sending a representative, they must bring written authorization from you, their own photo ID, and the order confirmation.

Failure to collect

Items not collected within the pickup window are forfeited
If you do not collect your items within the pickup period, your purchase price will not be refunded and you forfeit all rights to the items. We may re-list or otherwise dispose of uncollected items at our discretion.

Storage extensions

If you contact us before the pickup window expires, we may grant an extension at our discretion, subject to a storage fee per item per day. Extensions are not guaranteed.

Optional delivery

Delivery is available as an optional add-on through our third-party logistics partner (currently Unified Moving Master). Delivery charges are in addition to the purchase price and are non-refundable once dispatched. Delivery timelines are estimates only. Once items are handed to the delivery provider, risk of loss transfers to them — any claims for transit damage or loss must be directed to the delivery provider.

Items Conditions

All items sold as-is

No warranties on items
All items are sold as-is, where-is, with no warranties of any kind — express or implied — including warranties of merchantability or fitness for a particular purpose. We make no representation that any item is in working condition, complete, or free from defects.

Our inventory consists primarily of retailer returns, overstock, and general cleared merchandise. Items may have been previously opened, used, or returned. By bidding, you accept the inherent uncertainty of this type of inventory.

Item descriptions

Descriptions are provided in good faith based on available information at the time of listing. We will disclose known defects where we are aware of them. However, descriptions do not constitute warranties or guarantees about condition or functionality. Review all available information before bidding.

Your statutory rights

Nothing in this agreement limits any statutory right that cannot be lawfully excluded under applicable law, including the Consumer Protection Act, 2002, or the Sale of Goods Act (Ontario).

Regulated and recalled products

We take reasonable steps to check items against Health Canada recall databases before listing. However, given the nature of bulk-purchased inventory, exhaustive pre-sale inspection of every item is not always feasible. If you discover that an item you purchased is subject to a recall, contact us immediately and consult the Health Canada recall database at canada.ca/recalls.

We do not knowingly list used child car seats, items under mandatory recall, prescription medications, controlled substances, or any item prohibited from resale under applicable law.

Cancellations and returns

General policy

All sales are final. We do not accept returns based on change of mind, dissatisfaction with condition, or failure to read the item description before bidding.

Legal entitlements

If you believe you are entitled to a refund under applicable law, contact us in writing as soon as possible with your order confirmation number and the grounds for your claim. We will acknowledge within two business days and respond within five business days.

Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from an item or your use of the platform is limited to the purchase price you paid for that specific item. We are not liable for indirect, incidental, or consequential losses including loss of revenue, property damage, or personal injury arising from item defects.

We do not warrant that the platform will always be available, uninterrupted, or error-free. Nothing in this section limits any right a consumer may enforce under applicable statute.

Privacy and communications

Privacy

How we collect, use, and protect your personal information is described in our Privacy Policy, incorporated into these terms by reference. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA). We share your information only with Stripe (payments), our delivery provider (if you select delivery), and our email platform (for communications you have consented to).

Email communications

By creating an account or completing a purchase, you provide implied consent to receive commercial emails about upcoming auctions and promotions in accordance with Canada's Anti-Spam Legislation (CASL). Every marketing email includes an unsubscribe link. Transactional emails — order confirmations, pickup notifications — will be sent regardless of marketing preferences as they are necessary to complete your purchase.

Acceptable use

You agree not to use the platform to: place bids you have no genuine intention or financial ability to complete; use bots, scripts, or automated tools to bid; gain unauthorized access to the platform or any account; interfere with any auction; or submit false information during registration.

Violations may result in immediate account suspension, forfeiture of pending bids and purchases, and legal action.

Governing law and disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any dispute not resolved informally is subject to the exclusive jurisdiction of the courts of Ontario sitting in Hamilton.

Before initiating any formal legal proceeding, you agree to contact us in good faith and attempt to resolve the dispute informally for at least 30 days.

Changes to these terms

We may update these terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. The version of these terms in force at the time of your bid governs that transaction.
